Hotel Services Agreement

General terms and conditions governing the relationship between the guest and the hotel establishment.


1. Parties

This agreement is entered into between:

THE SERVICE PROVIDER: RCJ Operadora Turística S.A. de C.V., trading as Hotel La Casa de los Patios, located at Vallarta 89, Centro, C.P. 49300, Sayula, Jalisco, Mexico.

THE GUEST: The individual or legal entity contracting accommodation services and/or complementary services offered by the establishment, whether directly, through the website, by phone or through third-party booking platforms.

2. Purpose of Agreement

This agreement regulates the provision of accommodation services that Hotel La Casa de los Patios offers to the guest, according to the conditions and policies established herein. The guest exclusively contracts nightly accommodation service.

The hotel may offer various additional services and amenities as a courtesy (restaurant, spa, pool, parking, among others). These complementary services are not part of the main accommodation provision, are offered as added value and, by their nature, may or may not be available at any time without constituting a breach of the contracted accommodation service.

3. Reservations

3.1 Procedure

Reservations can be made through the following channels:

  • Official booking engine: https://lacasadelospatios.gabsuite.com/, operated through the Getabed (MR) platform by Rakun Ventures.
  • Hotel informational website: lacasadelospatios.com.mx (no booking engine; reservations from this site redirect to the official engine).

  • By phone: +52 (342) 422-0112 or +52 (342) 109-7143
  • Authorized booking platforms (Booking.com, TripAdvisor, among others).

3.2 Confirmation

All reservations are subject to availability. Once confirmed, the guest will receive an email with reservation details, including dates, room type and total amount.

4. Reservation Guarantee

To guarantee the reservation, the guest must make a bank deposit equivalent to at least one (1) night of accommodation per reserved room, to the following account:

  • Bank: BanRegio

  • Account: 145-96627-001-5
  • CLABE: 0583 2000 0008 7831 16

The deposit receipt must be sent by email to reservaciones@lacasadelospatios.com.mx indicating the guest's name and reservation date.

Important: If the deposit receipt is not received at least 24 hours before the arrival date, the hotel reserves the right to cancel the reservation without prior notice.

5. Rates and Taxes

5.1 Accommodation Rates

Accommodation rates are variable and depend on the season, room type, current promotions and availability. The applicable price will be the one displayed at the time of making the reservation through the channel used (website, third-party platforms or directly with the hotel).

By confirming a reservation, the guest accepts the rate indicated at that time. Rates are subject to change without prior notice for future reservations.

5.2 Applicable Taxes

Accommodation rates will be subject to applicable taxes in accordance with current legislation:

  • VAT (Value Added Tax): at the current applicable rate.
  • Lodging Tax (ISH): at the current rate in the state of Jalisco.

5.3 Courtesies and Amenities

As part of the accommodation experience, the hotel may offer the following courtesies to its guests, subject to availability and without their provision constituting a contractual obligation:

  • Complimentary in-room coffee.
  • Complimentary in-room snacks.
  • Parking.
  • Pool access.
  • Wi-Fi in common areas and rooms.

The availability of these courtesies may vary due to maintenance, season, capacity or other operational circumstances. The temporary or permanent suspension of any of these amenities does not constitute a breach of the accommodation service nor generates the right to refund, compensation or any discount.

6. Payment Methods

The hotel accepts the following payment methods at the establishment:

  • American Express
  • MasterCard
  • Visa
  • Cash (Mexican pesos)
  • Bank transfer

Full payment for the stay must be settled at check-out, unless a different payment arrangement has been agreed upon.

7. Check-in and Check-out

  • Check-in: from 2:00 PM.
  • Check-out: until 12:00 PM.

The guest must present a valid official photo ID at the time of registration. If an invoice is required, tax information (RFC and tax address) must be provided at check-in or before the receipt is issued.

Late check-out is subject to availability and may incur additional charges. Please inquire at the front desk about late check-out availability.

8. Cancellation Policy

  • To cancel or modify a reservation, the guest must contact the hotel at least 24 hours before the arrival date.
  • Cancellations made less than 24 hours in advance will not generate a refund of the guarantee deposit.
  • No refunds are given for incomplete stays, early departures or unused nights.

9. No-Show

If the guest does not show up on the reserved date without prior notice, a charge equivalent to one (1) night of stay will be applied. The reservation for the remaining nights may be cancelled at the hotel's discretion.

10. Children Policy

  • Children ages 0-8: free of charge, provided they share a room with a responsible adult and no extra bed is required.
  • From age 9: charged as an adult.
  • The hotel has children's play areas and a nursing area.

11. Pet Policy

No pets are allowed on hotel premises, with the exception of duly accredited service animals in accordance with applicable regulations.

12. Guest Responsibilities

The guest agrees to:

  • Make proper use of the hotel's facilities, furniture and equipment.
  • Respect the rules of coexistence and quiet hours from 10:00 PM.
  • Report any damage or defect upon detection.
  • Be responsible for damage caused to the hotel's facilities, furniture or equipment during their stay, which will be charged at replacement cost.
  • Respect the maximum occupancy capacity per room.

13. Hotel Responsibilities

The hotel agrees to:

  • Provide contracted services according to the quality standards offered.
  • Maintain facilities in optimal hygiene and safety conditions.
  • Address guest requests and complaints in a timely manner.
  • Safeguard the guest's personal data in accordance with the Privacy Notice.

The hotel is not responsible for valuables, cash or documents that have not been deposited in the front desk safe. Guests are advised to request the safekeeping service.

14. Complementary Services and Amenities

The following services are offered as a courtesy or additional service for hotel guests. They are not part of the contracted accommodation service and their availability may vary without prior notice due to operational, maintenance, seasonal or capacity reasons.

14.1 Spa

Spa treatments are an additional service independent from accommodation, subject to availability and prior reservation. Treatment cancellation must be made at least 4 hours in advance; otherwise, 50% of the service will be charged. Spa unavailability does not affect the accommodation service.

14.2 Restaurant

Food and beverage service is a complementary courtesy to accommodation. Additional food and beverage services, when available, will be charged separately according to the current menu and may be charged to the room account. Restaurant service hours and availability may vary.

14.3 Events

Contracting event spaces (weddings, corporate meetings and others) is governed by a specific event contract, independent from this accommodation agreement. Please inquire about availability and conditions with the sales department.

14.4 Other Amenities

General hotel amenities (pool, parking, Wi-Fi, common areas, among others) are provided as a courtesy and are subject to availability. The hotel may temporarily suspend any of these services for maintenance, safety, weather or other operational reasons, without generating any liability or right to compensation.

15. Room Assignment and Changes

Due to the nature of Hotel La Casa de los Patios as a boutique establishment with limited capacity, the hotel reserves the right to make changes to room assignments at check-in or during the guest's stay, for reasons such as:

  • Unforeseen maintenance or emergency repairs in the originally assigned room.
  • Force majeure events affecting the availability of a specific room.
  • Operational needs inherent to a limited-capacity hotel.
  • Unforeseen situations that make it impossible to deliver the reserved room in optimal conditions.

In such cases, the hotel will assign a room of equal or higher category than the one originally reserved. The guest will be informed of the change at check-in or as soon as possible. Room changes do not generate the right to free cancellation, refund or additional compensation, as long as the assigned room is of equivalent or higher category.

16. Force Majeure

The hotel shall not be liable for failure to fulfill its obligations when such failure is a consequence of force majeure or fortuitous events, such as natural disasters, pandemics, government actions, social conflicts or other circumstances beyond its control. In such cases, the hotel will make its best effort to offer alternatives to the guest.

17. Claims and Dispute Resolution

Any claim related to the services provided must be submitted during the stay or within 15 calendar days after the guest's departure, in writing or via email to reservaciones@lacasadelospatios.com.mx.

The parties agree to resolve any dispute arising from this agreement amicably. If no agreement is reached, they shall submit to the jurisdiction of the competent courts of the state of Jalisco, Mexico, waiving any other jurisdiction that may correspond to them by reason of domicile.

18. Applicable Legislation

This agreement is governed by the laws of the United Mexican States, in particular by:

  • Federal Consumer Protection Law.
  • General Tourism Law.
  • Official Mexican Standard NOM-010-TUR-2001 (requirements for accommodation establishments).
  • Federal Law on Protection of Personal Data Held by Private Parties.
  • Federal Civil Code and the Civil Code of the State of Jalisco.

19. Acceptance

By making a reservation, completing check-in or using any of the hotel's services, the guest expresses their agreement and acceptance of these terms and conditions in their entirety.
